1. Introduction & Acceptance

Welcome to Ghyaan ("we," "our," "us," or the "Platform"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ghyaan governing your access to and use of our website located at https://www.ghyaan.com, our mobile application, and all related services (collectively, the "Services").

By creating an account or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Services.

2. Definitions

  • "Content" means all text, graphics, questions, explanations, simulations, analytics, audio, video, and other materials available through the Platform.
  • "Premium Access" means paid subscription plans that unlock additional features and content beyond the free tier.
  • "User Content" means any data, responses, feedback, or information submitted by you through the Platform.
  • "Mock Test" means a practice examination designed to simulate the format and difficulty of a real competitive exam.

3. Eligibility

You must be at least 13 years of age to use the Platform. Users between 13 and 18 years of age must have parental or guardian consent to use the Services. By using the Platform, you represent and warrant that you meet these age requirements and, if a minor, that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If we learn that a user is under 13, we will terminate their account and delete associated personal data in accordance with our Privacy Policy and applicable law.

4. Account Registration & Security

To access most features, you must create an account by signing in via a supported third-party authentication provider (e.g., Google Sign-In). You are responsible for:

  • Maintaining the confidentiality and security of your account credentials.
  • All activities occurring under your account, whether authorized or unauthorized.
  • Notifying us immediately at support@ghyaan.com of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

5. Description of Services

Ghyaan is an online platform that requires a stable internet connection to access and use its Services. The quality of your experience may depend on your internet connectivity. Ghyaan provides an educational technology platform offering:

  • Mock tests and practice sessions for competitive examinations including CLAT, JEE Main, JEE Advanced, NEET, UPSC Prelims, SSC CGL, SSC CHSL, RRB NTPC, and NCERT Foundation courses.
  • Interactive STEM simulations for physics, chemistry, and mathematics concepts.
  • Performance analytics including topic-wise analysis, accuracy trends, time tracking, and competitive leaderboards.
  • Multilingual support across 11 Indian languages (currently available for UPSC Prelims; support for other exams will be extended gradually).
  • Text-to-speech accessibility features.
  • Progressive Web App (PWA) with offline capabilities.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, and without liability to you.

6. Free and Premium Access

The Platform operates on a freemium model. Certain features and content are available free of charge, while additional features ("Premium Access") require a paid subscription. The specific features included in each tier are detailed on our Pricing page and may change from time to time.

Free tier access may be subject to usage limits, including but not limited to the number of mock tests, practice sessions, or analytics features available per day or per month.

7. Payments, Pricing & Taxes

Premium Access is offered as a one-time purchase for a fixed subscription duration as specified on our Pricing page. Key payment terms:

  • All prices are listed in Indian Rupees (₹ INR) and are inclusive of applicable Goods and Services Tax (GST) unless otherwise stated.
  • Payments are processed securely by our PCI DSS-compliant third-party payment gateway. We do not store, process, or have access to your credit/debit card details or banking information.
  • Payment confirmation and premium access activation are typically instantaneous upon successful transaction.
  • We reserve the right to modify our pricing at any time. Price changes will not affect existing active subscriptions.

8. Subscription Duration & Expiry

Premium subscriptions are non-recurring and non-auto-renewing. Your Premium Access begins immediately upon successful payment and expires at the end of the purchased duration. Upon expiry, your account will automatically revert to the free tier. No data will be lost, but access to premium features will be restricted.

9. Intellectual Property Rights

All Content on the Platform — including but not limited to text, graphics, questions, explanations, simulations, logos, icons, audio, video, software code, and user interface design — is the sole and exclusive property of Ghyaan or its content licensors and is protected by Indian and international copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, distribute, or publicly display any Content from the Platform.
  • Use automated tools (scrapers, bots, crawlers) to extract Content.
  • Create derivative works based on our Content.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices.
  • Resell, sublicense, or commercially exploit our Content or Services.

10. User Conduct & Prohibited Activities

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.
  • Attempt to gain unauthorized access to other user accounts, our servers, or any connected systems.
  • Upload, transmit, or distribute any viruses, malware, or harmful code.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Use the Platform to share, distribute, or reproduce exam questions or answers in a manner that violates examination body guidelines.
  • Share your account credentials with others or allow multiple individuals to use a single account.

11. Third-Party Services

Our Platform integrates with third-party services to provide certain functionalities:

  • Cloud Infrastructure Provider — Authentication, database, hosting, and serverless computing.
  • OAuth Provider — Secure third-party authentication (e.g., Google Sign-In).
  • Payment Gateway — Secure payment processing (PCI DSS-compliant).

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of any third-party service providers.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Services will be uninterrupted, timely, secure, or error-free; (b) any Content will be accurate, complete, or current; (c) the results obtained from the use of the Services will meet your expectations; or (d) your exam performance will improve as a result of using our Platform.

Content Accuracy & Error Resolution: While the Company exercises the utmost academic rigor and editorial diligence to ensure the accuracy, completeness, and reliability of all examination content, explanations, and simulations provided on the Platform, inadvertent inaccuracies or typographical errors may occasionally occur. The Company makes no absolute guarantee regarding the total absence of such errors. Any discrepancies or factual errors brought to our attention by users or subject matter experts will be promptly logged, comprehensively reviewed, and appropriately rectified during our scheduled periodic content updates. The presence of such inaccuracies shall not constitute grounds for monetary liability or refunds.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GHYAAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA OR CONTENT.

In no event shall our total aggregate liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or ₹1,000 (Indian Rupees One Thousand), whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ghyaan, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your User Content.

15. Termination & Suspension

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without prior notice, for conduct that we determine:

  • Violates these Terms or our Privacy Policy.
  • Is harmful to other users, us, or third parties.
  • Involves fraudulent, abusive, or illegal activity.

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimer, limitation of liability, and indemnification clauses.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Bengaluru, Karnataka, India. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and binding.

Subject to the arbitration clause above, the courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction.

17. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified via email, in-platform notification, or by prominently posting a notice on our website. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically for any changes.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ghyaan regarding the use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
